Guyanese Tragically Killed After Being Hit By Car in Queens, New York

Jaipaul Persaud sadly died on Sunday, March 14th, two days after being struck by a vehicle in the Briarwood section of Queens.

Persaud, 55, was hit at about 1:30 p.m. on Friday by a 2013 Hyundai Elantra as he attempted to cross Queens Boulevard at 84th Avenue. Persaud was in or very close to the crosswalk at the time of the collision. The pedestrian sign at the intersection may have had a been flashing green for a pedestrian to cross. Persaud had been visiting his mother, who lives three blocks away when he was struck.

Persaud was rushed to Jamaica Hospital with severe head injuries and later died. The New York Police Department (NYPD) is investigating the accident.

During the probe, the NYPD will review several factors in the crash, including examining if Mr. Persaud was in the crosswalk at the time of the collision.

According to Candice Bond, an experienced pedestrian accident attorney, pedestrians generally have the right-of-way at crosswalks.

 “In most instances, pedestrians possess the right of way when crossing an intersection or a street regardless of if they are in a marked crosswalk,” said Bond, Managing Partner of Bond Legal. “It is always a driver’s duty to yield to any pedestrian.”

Crashes such as this are also often the result of speeding, distracted driving, negligent driving, and drivers failing to yield to pedestrians. Bond noted that an independent investigation should also be conducted to review if the pedestrian sign was working correctly when Persaud crossed. It is New York City’s obligation to ensure that all traffic devices are operating correctly to keep drivers, bicyclists, and pedestrians safe.

“Having the proper resources is extremely important in order to investigate a pedestrian accident case and prove negligence,” Bond said. “Road conditions, signage visibility, and road lighting are all possible contributing factors that are considered and must thoroughly be examined. Pending the investigation, the family of Jaipaul Persaud may be entitled to a wrongful death claim.
